🔹Section 154 CrPC – Right to Register FIR (Police Deny Nahi Kar Sakti)
🔹Short Note (Hindi):
Agar aap kisi crime ke witness ya victim hain, to aapko FIR likhwane ka poora adhikaar hai.
Police aapki FIR likhne se mana nahi kar sakti, chahe crime chhota ho ya bada.
Ye kanoon Section 154 CrPC me likha gaya hai — jisme police ko FIR turant likhni hoti hai, jab bhi kisi cognizable offence (serious crime) ki information milti hai.
🔹Full Description (English + Hindi):
🔹 What Section 154 Says:
“Every information relating to the commission of a cognizable offence, if given orally to an officer in charge of a police station, shall be reduced to writing by him or under his direction, and shall be read over to the informant.”
Yani, agar koi vyakti police ko cognizable offence (jaise murder, rape, theft, fraud, etc.) ke baare me batata hai,
to police ko FIR likhni hi padegi — chahe wo oral (bolkar) ho ya written (likhit) form me.
🔹 Key Points of Section 154:
- FIR Likhnā Police ka Farz Hai:
Police mana nahi kar sakti agar crime cognizable ho (jahaan police bina warrant ke arrest kar sakti hai). - Written or Oral Both Accepted:
Aap FIR likhit form me de sakte hain ya bolkar bataye to police likhti hai aur aapko padkar sunana hota hai. - Signature Required:
FIR likhne ke baad complainant (aap) ka signature lena zaroori hai. - Free Copy Milni Chahiye:
Aapko FIR ki ek free copy milni chahiye — ye aapka legal right hai. - Women Complaints:
Agar complainant mahila hai (especially sexual offence case me), to FIR lady officer ke dwara record ki jani chahiye. - Online & Email Complaint:
Agar police station FIR likhne se mana kare, to aap email, online portal, ya SP (Superintendent of Police) ko likh kar bhi complaint kar sakte hain.
🔹 Example:
Rina ke saath market me snatching hui. Jab wo police station gayi, to constable ne FIR likhne se mana kar diya.
Par CrPC Section 154 ke tahat ye mana karna illegal hai.
Rina ne likhit complaint SP ko bhej di — jise SP ne FIR ke roop me register kar diya.
🔹 If Police Denies to Register FIR:
Agar police aapki FIR likhne se mana kare:
- Complaint likhit me SP (Superintendent of Police) ko bheje.
- Aap Section 156(3) ke tahat magistrate ke samne application de sakte hain.
- Aap online FIR portal (state police website) par bhi FIR file kar sakte hain.
🔹Important Case Laws:
- Lalita Kumari vs Govt. of U.P. (2013)
Supreme Court ne kaha — “Registration of FIR is mandatory for every cognizable offence. Police cannot refuse.” - State of Haryana vs Bhajan Lal (1992)
Court ne bataya ki FIR sirf valid information milne par hi reject nahi ki ja sakti — inquiry ke liye register karna hi hoga.
🔹Nyay Neeti View (Legal Awareness):
Section 154 CrPC ensures ki justice delay na ho.
Kai baar police pressure, politics, ya influence ke wajah se FIR likhne se katrati hai — lekin kanoon me citizen ke favour me protection diya gaya hai.
Har insaan ko apne upar hue crime ke khilaf FIR likhane ka fundamental right hai.
