🔹Short Note (Hindi):

Section 9 Civil Procedure Code (CPC) kehta hai ki civil courts ko sabhi civil nature ke cases sunne ka adhikar hai, jab tak ki law us case ko specifically kisi aur authority ko assign nahi karta.
Simple shabdon me — civil court har wo case sun sakti hai jo kisi vyakti ke civil right ya property se related ho.

🔹 What Section 9 CPC Says:

“The courts shall (subject to the provisions herein contained) have jurisdiction to try all suits of a civil nature excepting suits of which their cognizance is either expressly or impliedly barred.”

Matlab ye section clearly batata hai ki civil courts sabhi civil nature ke matters (jaise property, contract, marriage rights, etc.) sun sakti hain.
Lekin agar kisi law me likha hai ki wo case kisi aur tribunal ya authority ke paas jayega, to civil court usme interfere nahi karegi.


🔹 Meaning of ‘Civil Nature’:

“Civil Nature” ka matlab hai — aise disputes jaha kisi vyakti ke personal ya proprietary rights affect ho rahe hain.
Example:

  • Property dispute
  • Contract or agreement dispute
  • Divorce or maintenance case
  • Defamation suit
  • Partition of property

Criminal offence (like theft, murder, fraud, etc.) civil nature me nahi aata.


🔹 When Civil Court Can’t Intervene:

Civil court case nahi le sakti agar:

  1. Law me express bar likha ho (example – Revenue matters, election disputes, etc.)
  2. Implied bar ho (means indirectly kisi aur authority ko power di gayi ho).

Example:
Election se related matter ko Election Tribunal hi sunta hai, civil court nahi.


🔹 Objective of Section 9:

Section 9 ka main purpose hai ensure karna ki civil courts sabhi civil disputes ke liye open ho, aur log apne rights ke protection ke liye court ja sakein.
Yani — “Justice shall not be denied unless specifically barred by law.”


🔹 Example Case:

Ravi ne apne neighbour ke khilaf property boundary dispute ka case file kiya.
Ye ek civil nature ka matter tha, isliye Civil Court ne us case ko accept kiya.
Agar ye election ya revenue issue hota, to Civil Court ke paas jurisdiction nahi hoti.

Supreme Court ne kaha —

“Civil Court ka jurisdiction har civil matter me hota hai, unless statute ne usse exclude kiya ho.”
