🔹 Section 80 CPC – Notice to Government or Public Officer Before Filing a Suit


🔹Short Note (Hindi):

Section 80 CPC kehta hai ki agar koi vyakti Sarkar ya kisi Government Officer ke against case file karna chahta hai, to use 60 din pehle ek legal notice dena zaroori hai.
Yaani bina notice diye direct court me case file nahi kar sakte — exception sirf emergency cases me hoti hai.

🔹 What Section 80 CPC Says:

“No suit shall be instituted against the Government or against a public officer in respect of any act purporting to be done by such public officer in his official capacity, until the expiration of two months after notice in writing has been delivered or left at the office of the Government or public officer.”

Simple words me:
Agar aapko Central Government, State Government, ya kisi government officer (jo apne official duty me kaam kar raha tha) ke khilaf case file karna hai, to pehle 2 months ka notice dena mandatory hai.


🔹 Purpose of Section 80:

  1. To give Government time to settle the dispute without going to court.
  2. To avoid unnecessary litigation.
  3. To inform the Government about the complaint and allow them to investigate internally.

🔹 Who Needs to Be Given Notice:

  • Central Government (through Secretary of concerned department).
  • State Government (through Collector or Secretary).
  • Public Officer (through his office address).

🔹 Contents of the Notice:

Notice me yeh sab cheezein likhna zaroori hai:

  1. Plaintiff ka naam, address aur signature.
  2. Defendant (Government ya Officer) ka name aur office.
  3. Cause of action – kis wajah se case file ho raha hai.
  4. Relief claimed – plaintiff kya chah raha hai (compensation, order, etc.).
  5. Sufficient detail jisse Government ko matter samajh aaye.

🔹 Time Limit:

Notice dene ke baad 60 days ka waiting period mandatory hai.
Sirf uske baad hi aap court me suit file kar sakte ho.


🔹 Exception (Sub-Section 2):

Agar case urgent hai aur delay se irreparable loss ho sakta hai, to court permission dekar bina notice ke bhi suit file karne ki ijazat de sakti hai.
Lekin court us situation me Government ko turant inform karti hai.


🔹 Example:

Manoj ne ek government officer ke khilaf complaint file karni chahi, kyunki us officer ne uski property illegally seize kar li.
Manoj ko pehle Section 80 CPC ke tahat ek legal notice dena hoga us officer aur department ko, jisme wo apni complaint aur relief likhega.
Agar 60 din me government reply nahi karti, tab Manoj case file kar sakta hai.

Court ne kaha – Section 80 notice is mandatory before filing any suit against the Government or public officer.

(2) Ghanshyam Dass vs Dominion of India (1984)
Court ne explain kiya – The object of Section 80 is to give the Government an opportunity to reconsider its legal position and settle the claim without litigation.

(3) State of A.P. vs Pioneer Builders (2006)
Held – A defective notice may be ignored if it substantially conveys the necessary information.
