Hindu Succession Act, 1956
Section 14 – Property of a Female Hindu
🔹 Short Note (Hindi)
Section 14 kehta hai ki ek Hindu mahila agar kisi property ki malik hai—chahe wo property usne khud kharidi ho, virasat me pai ho, gift ke roop me mili ho, ya maintenance ke liye di gayi ho—to wo property uski poori aur absolute milkiyat (Stridhan) hoti hai. Is par kisi ka control nahi hota.
🔹 Detailed Explanation (English + Hindi)
Section 14 provides that any property owned by a female Hindu becomes her absolute property, not limited or restricted in ownership.
Agar ek aurat ko property milti hai:
- Inheritance (विरासत),
- Partition (बंटवारा),
- Gift (उपहार),
- Will (वसीयत),
- Maintenance (भरण-पोषण),
- Purchase (खरीद),
- Family arrangement (समझौता),
to wo property uski poori ownership me mani jayegi, unless it’s clearly given as a restricted estate under sub-section (2).
🔹 Section 14 divides into two parts:
(1) Absolute Ownership:
Sari property jo female Hindu ke paas hai, wo poori tarah uski hoti hai, chahe kabhi bhi mili ho.
(2) Restricted Estate:
Agar kisi document, will, ya agreement ke through property sirf limited right ke sath di gayi hai (life interest only), tab wo restricted mana ja sakta hai.
🔹 Main Conditions
- Woman must be a Hindu by religion.
- Property must be acquired legally (gift, will, inheritance etc.).
- If property is received before or after 1956, both covered.
- Default rule: absolute ownership, unless restricted by document.
- Stridhan bhi included.
🔹 Legal Meaning (Simple Terms)
Agar ek Hindu mahila ke naam property hai, to us par poora adhikar uska hota hai—wo bech sakti hai, gift kar sakti hai, transfer kar sakti hai, ya will bana sakti hai. Kisi relative ka us par control nahi.
Sirf tab restriction hai jab property kisi document me specifically limited estate ke roop me di gayi ho.
🔹 Example
Sharda ko maintenance ke liye pati ke bhai ne zameen di. Wo document me restricted nahi thi.
Section 14(1) apply hoga → zameen Sharda ki poori ownership me aa jayegi.
Wo chahe to bech sakti hai, will kar sakti hai, ya transfer kar sakti hai.
🔹 Key Legal Points
- Stridhan is full ownership
- Maintenance ke roop me mili property bhi absolute hai
- Married, unmarried, widow—all women covered
- Limited rights only tab jab document restrict kare
- Property before and after 1956 included
- No male relative can claim control over it
🔹 Nyay Neeti Advice
Agar kisi ne kaha ho ki property sirf use karne ke liye hai ya mahila ko haq nahi hai:
- Property document check karen
- Limited estate tabhi hoti hai jab likhit me ho
- Court female ke ownership right ko strongly protect karti hai
