🔹Short Note (Hindi):

Section 10 ka simple matlab hai — agar ek hi matter par ek case court me pehle se chal raha hai, to doosra case usi issue par file nahi kiya ja sakta, ya agar kiya gaya hai to court usko rok degi (stay karegi).
Yani — “Ek hi mudde par do baar case nahi chalega.”

🔹 What Section 10 CPC Says:

“No Court shall proceed with the trial of any suit in which the matter in issue is also directly and substantially in issue in a previously instituted suit between the same parties.”

Simple words me:
Agar ek case kisi same matter par pehle se kisi court me chal raha hai, to dusri court us case ko continue nahi karegi.
Iska main maksad hai duplicate litigation se bachna aur judicial time save karna.


🔹 Purpose of Section 10:

  1. Avoid conflicting judgments – same case par alag-alag decision na aaye.
  2. Save time and cost – ek hi matter par bar-bar trial hone se rokta hai.
  3. Ensure judicial discipline – ek hi case ek hi court me decide ho.

🔹 Essential Conditions:

Section 10 tab apply hota hai jab:

  1. Do suits ho – ek pehle se pending ho aur dusra later file hua ho.
  2. Parties same ho – dono cases me same log involved ho.
  3. Subject matter same ho – dono cases me ek hi issue dispute me ho.
  4. Earlier case competent court me pending ho – pehle wala case ek aisi court me ho jise decision dene ka adhikar hai.

Agar ye 4 condition puri ho jaayein, to second suit stay (ruk) ho jaata hai.


🔹 Example:

Ramesh ne Suresh ke against property ownership ke liye Delhi court me case file kiya.
Uske baad wahi issue par Suresh ne Mumbai court me case daal diya.
Yahan Section 10 apply hoga — Mumbai court apna case stay karegi, kyunki same matter Delhi court me pehle se chal raha hai.

(1) Indian Bank vs Maharashtra State Cooperative Marketing Federation (1998)
Supreme Court ne clarify kiya: Section 10 trial ko rokta hai, lekin suit file hone se nahi.
Yani case file kar sakte ho, lekin jab tak pehle wala case khatam nahi hota, doosra ruk jayega.

(2) Aspi Jal vs Khushroo Jal (2013)
Court ne kaha: Section 10 tabhi lagu hoga jab matter “directly and substantially same” ho — similar ya related hone par nahi.
