Agar husband ya uske family members wife ko torture, maar-peet, ya dowry ke liye mentally ya physically harass karte hain, to unke khilaf Section 498A IPC lagta hai.
Ye law women protection ke liye bana hai — taaki unhe domestic violence aur dowry harassment se nyay mil sake.


🔹 Full Description (English + Hindi):

🔹 Section 498A – Definition:

“Whoever, being the husband or the relative of the husband of a woman, subjects her to cruelty shall be punished with imprisonment for a term which may extend to three years and shall also be liable to fine.”

Simple words me:
Agar husband ya uske rishtedaar wife ke saath badtameezi, maar-peet, dhamki, ya paisa/dowry ke liye pressure banate hain — to ye ‘cruelty’ kehlata hai aur ye non-bailable offence hai.


🔹 Meaning of Cruelty:

“Cruelty” ka matlab sirf maar-peet nahi hota.
Law ke hisaab se cruelty ke do main forms hain

  1. Physical Cruelty:
    • Maar-peet, physical injury, ya jaan ko khatra.
    • Example: Regular violence, locking her in a room, denying food.
  2. Mental Cruelty:
    • Emotional torture, insult, humiliation, ya threat dena.
    • Example: Constant dowry demands, character assassination, threatening divorce.

🔹 Dowry Harassment:

Agar husband ya uske family ne wife par dowry (dahej) ke liye mental pressure dala, ya usse maar-peet ki, to ye 498A ka part hai.

Dowry Demand = Illegal under Dowry Prohibition Act, 1961 + 498A IPC

  • Ye offence cognizable (police can arrest without warrant) aur non-bailable hai.
  • Complaint wife khud ya uske parents/relatives bhi kar sakte hain.
  • Case usually women’s cell / CAW cell ke through investigate hota hai.

  • Imprisonment: Up to 3 years
  • Fine: Court ke discretion ke hisaab se

Kuch cases me 498A ka galat use bhi dekha gaya hai — jahan false cases file kiye gaye.
Isliye Supreme Court ne clarify kiya hai ki proper investigation ke baad hi arrest kiya jaaye.

Courts ne kaha hai ki “cruelty” ka matlab continuous and intentional harassment hota hai — ek chhoti baat se ye section nahi lagta.
