🔹 Meaning of Section 363:
This section punishes anyone who kidnaps a person from lawful guardianship.
In simple words — agar koi kisi minor (bachche) ya kisi aur vyakti ko uske guardian ke permission ke bina le jaata hai, ya usse dur rakhta hai, toh ye kidnapping kehlata hai.
🔹 Main Elements:
- Kidnapping must be from lawful guardianship (i.e., from parent or legal guardian).
- The victim must be under 18 years (female) or under 16 years (male).
- The act must be without the guardian’s consent.
- The person must have taken or enticed the child or person away.
🔹Explanation (Simple Hindi):
Kidnapping ka matlab hota hai kisi vyakti, khaaskar bacche, ko uske guardian ki marzi ke bina kahi le jaana.
Chahe wo school se ho, ghar se ya road se — agar guardian ki permission nahi hai, toh ye crime hai.
Isme chahe koi “red van” jaisi dramatic situation ho ya koi jaankar insaan hi bacche ko le jaaye — dono halat me kanoon kehta hai, ye kidnapping hai.
