Section 57 CrPC kehta hai ki police kisi bhi vyakti ko 24 ghante se zyada apni custody me nahi rakh sakti bina court ke order ke.
Yani agar kisi ko arrest kiya gaya hai, to usse 24 ghante ke andar magistrate ke samne pesh karna hi hoga.
Ye rule isliye hai taaki police kisi ko galat tareeke se torture na kare ya illegal custody me na rakhe.

🔹 What Section 57 Says:

“No police officer shall detain in custody a person arrested without warrant for a period longer than under all the circumstances of the case is reasonable, and such period shall not exceed twenty-four hours.”

Yani agar kisi vyakti ko bina warrant ke arrest kiya gaya hai, to police usse reasonable time, par maximum 24 ghante tak hi rakh sakti hai.
Uske baad court (magistrate) ke order ke bina usse custody me rakhna illegal hai.


🔹 Purpose of Section 57:

Section 57 ka main maksad hai citizen ke personal liberty ko protect karna.
Ye ensure karta hai ki police apni power ka misuse na kare aur kisi ko bina reason ke custody me na rakhe.

  1. 24 Hours Limit: Arrest hone ke baad 24 ghante ke andar magistrate ke samne pesh karna compulsory hai.
  2. Time Includes Travel: 24 ghante me police station se court tak ka travel time bhi include hota hai.
  3. Magistrate Approval Needed: Agar investigation complete nahi hota to police magistrate se remand maang sakti hai.
  4. Beyond 24 Hours = Illegal Detention: Agar koi 24 ghante se zyada police custody me hai bina remand ke, to wo illegal custody kehlata hai.

Ramesh ko police ne Friday raat 9 baje arrest kiya.
Magistrate ke samne use Saturday raat 9 baje tak pesh karna tha.
Par police ne use Sunday tak rakha bina order ke —
Ye illegal detention mana jayega aur Ramesh ke paas compensation aur legal action ka right hoga.

    Supreme Court ne kaha — “Every arrested person must be presented before a magistrate within 24 hours; failing which it becomes illegal detention.”
  2. Joginder Kumar vs State of U.P. (1994)
    Court ne bataya ki arrest sirf suspicion par nahi hona chahiye — police ko valid reason batana hoga.

  • Article 22(2) – Every person who is arrested shall be produced before a magistrate within 24 hours.
