Section 41 CrPC kehta hai ki Police kuch special situations me bina court ke warrant ke bhi kisi person ko arrest kar sakti hai.
Ye power tab use hoti hai jab crime serious ho, ya proofs ko destroy karne ka danger ho, ya accused bhaag sakta ho.

🔹 Section 41 – Power of Police to Arrest Without Warrant:

According to Criminal Procedure Code (CrPC), police ko ye right hota hai ki wo kuch specific conditions me kisi person ko bina warrant ke arrest kar sakti hai.
Lekin ye power limitless nahi hai — police ko har baar reason batana zaruri hai aur arrest lawful ground pe hi karna chahiye.


🔹 When Police Can Arrest Without Warrant (Important Points):

Police bina warrant arrest tab kar sakti hai jab –

  1. Person ne cognizable offence kiya ho
    (Cognizable offences = serious crimes jisme police khud investigation start kar sakti hai jaise murder, rape, theft etc.)
  2. Warrantable offence hone ka strong suspicion ho
    (Agar police ko reasonable doubt hai ki person ne serious offence kiya hai.)
  3. Court ke order ka violation hua ho
    (Agar koi court ke rule, bail condition ya summons violate kare.)
  4. Accused bhagne ki koshish kar raha ho
    (Agar suspect evidence destroy kare ya bhaagne ki planning me ho.)
  5. Stolen property milti hai
    (Agar kisi ke paas chori ka saman mile.)
  6. Identity confirm nahi ho rahi ho
    (Agar person apna naam, address ya pehchaan batane se inkar kare.)
  7. Proclaimed offender ho
    (Agar court ne us person ko “wanted” ya “absconder” declare kar rakha ho.)

🔹 Example (Simple Explanation):

  • Example 1:
    Police ko news milti hai ki ek aadmi ne kisi ka phone chura liya hai aur wo bhaagne ki koshish kar raha hai —
    🔹 Police bina warrant arrest kar sakti hai (theft = cognizable offence).
  • Example 2:
    Agar koi aadmi court ke bail condition tod deta hai ya date par hazir nahi hota,
    🔹 Police usse directly arrest kar sakti hai.
  • Example 3:
    Agar kisi vyakti ke paas illegal weapon milta hai, Police bina warrant action le sakti hai.

🔹 Important Rule (Human Right Protection):

Supreme Court ne kaha hai –

“Arrest bina reason ke nahi ho sakta. Police ko likhit reason dena zaruri hai.”

Matlab — agar police kisi ko bina warrant arrest karti hai, to arrest ke valid reason likhna mandatory hai, warna wo illegal arrest kehlata hai.

Iska matlab – police abuse of power nahi kar sakti, bina justification ke arrest karna human right violation hoga.
