🔹Short Note

IPC 375 & IPC 376 : IPC​‍​‌‍​‍‌ Section 375 essentially sets out the crime of rape and the conditions under which the sexual intercourse or certain sexual acts can be considered as rape. Further, IPC 376 specifies the penalty for this crime.

🔹Detailed Explanation

Indian rape laws mainly focus on IPC 375 and 376 of the Indian Penal Code. The main aim of these provisions was to redefine the crime of rape extensively and upgrade the punishments in response to sexual offences. This was done through the Criminal Law (Amendment) Act, 2013.

Section 375 – Definition of Rape

According to IPC 375, a man is said to have committed rape if he engages in certain sexual acts with a woman in certain circumstances as set out by the law. The core of the crime is the absence of free and willing consent.
One can call a sexual act rape if it is:
Forced on the woman against her will;
Without the woman’s consent;
With consent, the woman or any other person being put in fear of death or threat to the body;

Via fraud, e.g. the man pretended to be someone else or promised to marry the woman but it was a trick;
When due to one or more of unsound mind, intoxication or administration of a substance, the woman was not in a position to understand the nature and consequence of the act;
Whether with or without consent, if the woman is below the age stipulated by the law;
If the woman is so incapacitated that she is not even able to give consent verbally.

🔹Example

A​‍​‌‍​‍‌ man forcibly has sexual intercourse with a woman against her will. The act in this case is a rape in terms of Section 375 and the offender gets sentenced as per Section 376.
Similarly, if the consent comes after a threat of serious injury or through taking advantage of the person’s mental incapacity to understand the idea of the act, the criminal prosecution is possible.
If the victim is under the age legally set, the act can be counted as rape regardless of the fact that she seemed to agree and also the rules of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) may be put to use.
