🔹 Law Summary :

(This refers to Section 302 of the Indian Penal Code (IPC).) It includes that “Who ever commits murder shall be punished with death or imprisonment for life, and shall also be liable to fine.”

In other words — this part is about punishing the most serious crime of all — intentionally or knowingly taking another person’s life.

🔹 In Simple Words:

If someone deliberately or intentionally takes the life of a person, he can be awarded death penalty under section 302 IPC or life imprisonment. That means when someone has been killed “intentionally” — this is called a “Murder”.

🔹 Important Points to Understand:

Intention Matters:

If anybody gets angry, or planners take revenge and someone is killed — ye murder hai. Not Accidental:
If the death is accidental, without an intention — it can be “culpable homicide not amounting to murder” (Section 304).

🔹Punishment:

  • Death Penalty (Rarest of Rare Cases)
  • Life imprisonment
  • Plus penaltified (as determined by court).Burden of Proof:
  • Prosecution has to prove that accused killed someone intentionally.

🔹 Example (Real-life Style):

Let us assume that Rohan and Aman had a dispute. Rohan brings a knife from his home in anger and stabs Aman several times — Aman dies on the spot. Here Rohan acted intentionally to kill — so he shall receive a charge under Section 302 .But if during a scuffle, Rohan had shoved Aman and he fell down and died in the process — that is not Section 302; it will be under Section 304 (Culpable Homicide).
